1. Einleitung

Welcome to Chiro Sofort ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website at chirosofort.de, mobile applications, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

2. Annahme der Bedingungen

By creating an account, booking an appointment, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Platform.

3. Beschreibung der Dienste

Chiro Sofort is a healthcare technology platform that connects patients with licensed, insured chiropractors who provide at-home and in-office chiropractic services. We facilitate the booking, scheduling, payment processing, and communication between patients and providers. Chiro Sofort does not itself provide chiropractic or medical services.

4. Benutzerkonten

To use certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account credentials
• Promptly update your account information if it changes
• Accept responsibility for all activity that occurs under your account
• Use a password of at least 12 characters that meets our security requirements

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe to be fraudulent.

5. Behandler-Bedingungen

Chiropractors who register as providers on the Platform ("Providers") agree to the following additional terms:

• Maintain an active, valid chiropractic license in the state(s) where they practice
• Carry professional liability (malpractice) insurance with minimum coverage of $1,000,000
• Submit to and pass background check screening
• Comply with all applicable federal, state, and local laws and regulations
• Maintain HIPAA compliance in all patient interactions and record-keeping
• Provide services in a professional, ethical manner consistent with chiropractic standards of care

Providers are independent contractors and are not employees, agents, or representatives of Chiro Sofort.

6. Termine & Zahlungen

All appointments booked through the Platform are subject to the following:

• Pricing is displayed at the time of booking and is subject to the provider's rates
• Payment is processed securely through our third-party payment processor (Stripe)
• HSA and FSA cards are accepted for eligible services
• Cancellation policies are set by individual providers and displayed at the time of booking
• Superbills for insurance reimbursement are generated automatically after completed appointments

7. DSGVO & Datenschutz

We are committed to protecting your health information in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and applicable state privacy laws. 8. Geistiges Eigentum

All content, features, and functionality of the Platform — including but not limited to text, graphics, logos, icons, images, software, and the compilation thereof — are the exclusive property of Chiro Sofort or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our prior written consent.

9. Haftungsbeschränkung

To the maximum extent permitted by applicable law:

• Chiro Sofort is a technology platform and does not provide medical or chiropractic services. We are not responsible for the quality, safety, or legality of services provided by Providers.
• Chiro Sofort shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
• Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid to Chiro Sofort in the twelve (12) months preceding the claim.

10. Kündigung

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Anwendbares Recht

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Hillsborough County, Florida.

12. Änderungen der AGB

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
